As per Article 159 of the constitution, the Governor shall take oath or affirmation administered by the Chief Justice of the High Court of that State or in the absence by the Senior most Judge of that Court before assuming his office.

According to Article 154 of the Constitution, the executive power of the state will vest in the Governor, which he will exercise by himself or by his subordinate officers as per the Constitution. It is thus clear that the Governor is the constitutional head of state.

According to Article-202 (3) (a) of the Constitution, the salary and allowances of the Governor and other expenses related to his post; are charged on the Consolidated Fund of State. Salaries and allowances of the State Legislative Assembly Speaker, Deputy Speaker and High Court Judges are also charged on the Consolidated Fund of the State.

He can grant pardons, reprieves, respites and remissions of punishment or suspend, remit and commute the sentence of any person convicted of any offence against any law relating to a matter to which the executive power of the state extends. But he cannot pardon a death sentence.

Article-213 empowers the Governor to issue Ordinance. The Governor exercises this power when either of the two houses of the Legislature or both houses are not in session. If the Governor feels that such circumstances exist in which it is necessary to take immediate action, the Governor can issue an ordinance. If a resolution accepting the ordinance is passed within 6 weeks of the commencement of the session of the Legislature, it becomes an Act.

According to Article 200 of the Constitution, when a bill is presented to the Governor after passing it, the Governor has the right to pass, or to not pass the Bill or reserve the Bill for the consideration of the President.

As per Article 173 of the Constitution, the minimum age to become a member of the Legislative Assembly is 25 years. The minimum age to become a member of Legislative Council is 30 years.

According to Article-165 (2) of the Constitution, the Governor of each state may appoint a person who is qualified to be appointed a Judge of the High Court, Advocate-General of the State. It is the first law officer of the state government and its salary and allowances are determined by the governor.

According to Article 168 (2) of the Constitution, where there are two Legislature houses in a state, one is named Legislative Council or Upper House and the other is named Legislative Assembly or Lower House. In a state which has only one house, its name will be Legislative Assembly.

Sarojini Naidu is the first woman in India to be appointed to the post of Governor. She was the Governor of Uttar Pradesh from 15 August 1947, to 2 March 1949.
